1. Agreement to Terms

By engaging Apex Web Designs for web design and development services, you agree to these Terms of Service. These terms govern our professional relationship and set expectations for both parties throughout the project lifecycle.

2. Project Scope & Deliverables

The specific services and deliverables will be outlined in a detailed proposal or contract. Any changes to the project scope must be agreed upon in writing and may affect the project timeline and cost.

Deliverables typically include: Custom website design, responsive development, basic SEO setup, and post-launch support as outlined in your chosen package.

3. Payment Terms

We typically require a 50% deposit before commencing work. The remaining balance is due upon project completion and before launch. Payment plans are available for larger projects.

Accepted payment methods: Bank transfer, credit card, PayPal. All prices are in Australian Dollars (AUD) unless otherwise specified.

4. Revisions Policy

We include unlimited revisions during the design phase to ensure your complete satisfaction. Major scope changes or significant deviations from the approved design may incur additional charges.

Once a design is approved and development begins, changes to the approved design may incur additional costs based on the complexity of the requested changes.

5. Intellectual Property

Upon final payment, you will own the website design and content for the project. We retain the right to display the work in our portfolio and marketing materials unless otherwise agreed in writing.

Third-party assets (stock photos, fonts, plugins) are licensed for use on your website and may have their own terms of use.

6. Client Responsibilities

You are responsible for providing content, images, and materials in a timely manner. Delays in receiving your feedback or materials may affect the project timeline.

You warrant that you have the right to use all content and materials provided and that nothing infringes on third-party intellectual property rights.

7. Cancellation Policy

Either party may cancel the project with 14 days written notice. Upon cancellation, you will be invoiced for all work completed up to the cancellation date.

Deposits are non-refundable once work has commenced, as they cover our initial planning and resource allocation.

8. Warranty & Support

We provide a 30-day warranty period after launch for bug fixes and essential adjustments. Ongoing support and maintenance are available as a separate service.

This warranty does not cover changes requested after launch, third-party modifications, or issues caused by client editing of code.

9. Limitation of Liability

Our liability is limited to the total amount paid by you for our services. We are not liable for indirect, incidental, or consequential damages, including lost profits or business opportunities.
